1. Introduction / はじめに
Welcome to Mori Essence, a boutique travel design brand curated and operated by Essence Works – a Japan-based independent experience design studio. We offer personalized travel services focused on authentic, refined, and immersive experiences in Japan. By using our services or contacting us, you agree to the following Terms of Service.
Mori Essence（以下「当サービス」といいます）は、日本を拠点とする体験設計スタジオ「Essence Works」が運営する、オーダーメイド旅のデザインブランドです。本サービスをご利用いただくことで、本規約に同意いただいたものとみなします。
2. Nature of Services / サービスの性質
Mori Essence is not a licensed travel agency. We do not act as a booking intermediary. We provide curated recommendations, itinerary design, and cultural experience guidance.
While Mori Essence does not handle accommodations or transportation bookings, we may assist in reserving cultural or experiential activities on your behalf, depending on your selected service plan.
当サービスは旅行代理店ではなく、宿泊・交通・各種予約の代行を行いません。旅程の設計や体験の提案を通じて、お客様自身による自由な旅をサポートします。
当サービスは宿泊施設や交通手段の予約代行は行いませんが、ご契約プランに応じて、文化体験やアクティビティ等のご予約を代行する場合があります。
3. Client Responsibilities / お客様の責任
Clients are responsible for:
- Making all bookings directly
- Ensuring necessary documents and insurance are in place
- Managing their own schedule during travel
We are not liable for third-party service failures or on-the-ground issues.
以下についてはお客様の責任となります：
- ご自身による宿泊・移動・体験の予約手配
- パスポート、ビザ、保険などの準備
- 旅行中の予定や行動の管理
当サービスは第三者による提供サービスの遅延・中止・トラブルに対して一切の責任を負いません。
4. Scope of Support / サポート範囲
Our support is limited to pre-travel planning. We do not offer real-time support during the trip.
当サービスのサポートは旅行前の準備・計画に限られ、旅行中の緊急対応や現地でのサポートは含まれません。
5. Fees and Payment / 料金とお支払い
All service fees are provided prior to engagement and are for planning and consulting only.
Once planning has begun, payments are non-refundable except in cases of gross negligence.
- If canceled before itinerary planning begins: 90% refund (10% processing fee)
- If canceled after planning has begun: No refund
- If Mori Essence fails to deliver services due to gross negligence: Full or partial refund may apply
- Force majeure (natural disasters, emergencies) will be reviewed case by case
サービス料金は事前にご案内し、企画・コンサルティング業務に対する報酬です。
旅程設計が開始された後のキャンセルについては、重大な過失がない限り返金不可とします。
- 旅程設計の開始前にキャンセルされた場合：
料金の90%を返金いたします（10%は事務手数料として差し引かれます）
- 旅程設計の開始後にキャンセルされた場合：
返金は致しかねます。
- Mori Essenceの重大な過失によりサービス提供が困難となった場合：
全額または一部の返金が適用される可能性があります。
- *不可抗力（自然災害や緊急事態など）によるキャンセルの場合：
個別の状況を踏まえて対応を検討いたします。
6. Limitation of Liability / 免責事項
Mori Essence shall not be liable for:
- Injury, loss, or damages during travel
- Changes or cancellations by third parties
- Natural disasters, strikes, or unforeseen disruptions
当サービスは以下の損害に対して責任を負いません：
- 旅行中に生じた事故や損害
- 提携先や第三者による変更・キャンセル
- 天候や災害等による予期せぬトラブル
7. Intellectual Property / 知的財産権
All designs, itineraries, content, and recommendations remain the intellectual property of Mori Essence and may not be used or reproduced without permission.
提供されるすべてのコンテンツ・資料・デザイン・提案内容は当サービスに帰属し、無断転用・転載・再配布を禁止します。
8. Prohibited Activities / 禁止事項
Clients must not:
- Reproduce or resell itineraries or content
- Misrepresent or falsely affiliate with Mori Essence
- Disrupt or interfere with our service operations
以下の行為は禁止されています：
- 旅程表・資料などの無断転載・販売
- Mori Essenceを騙った営業・発信
- サービスへの妨害・営業妨害
9. Confidentiality / 守秘義務
We respect your privacy and will not share your journey details or personal information without consent, unless legally required.
お客様の個人情報・旅の詳細は、法的義務を除き、ご本人の同意なく第三者に開示いたしません。
10. Governing Law and Jurisdiction / 準拠法・裁判管轄
These Terms shall be governed by the laws of Japan. Any dispute shall be subject to the exclusive jurisdiction of the Tokyo District Court.
本規約は日本法に準拠し、関連するすべての紛争については東京地方裁判所を第一審の専属的合意管轄裁判所とします。
11. Modifications to Terms / 規約の変更
We reserve the right to revise these Terms at any time. Any updates will be posted on our website.
本規約は予告なく変更されることがあります。変更後はウェブサイトにて公開されます。
